サマリー Tech Fairは、企業が米国特許商標庁 (USPTO)の審査官に対して自社の注目技術のプレゼンテーションを行うUSPTO主催のイベントです。質疑応答を含む1時間で、特定の審査部門の数十名の審査官に対し、その注目技術に対して自社がどのようなアプローチで研究開発しているかを説明することができます。また、PETTPという審査官向け教育プログラムにおいて、同様の技術プレゼンテーションを行うこともできます。 Tech FairやPETTPに参加するメリットは、自社の特許出願を審査する審査部門の審査官と良好な関係性を構築し、自社技術の革新性をアピールし、それにより今後の自社出願の審査が円滑に進むことが期待される点です。弊所の多くのクライアント様がこの機会を活用し審査を有利に進めておりますので、ご興味ある方はぜひお知らせください。 背景 USPTOでは、毎年、各審査部門（Technology Center: TC）毎に、出願人である企業側がUSPTOの審査官に対して自社の注目技術のプレゼンテーションを行うTech Fairというイベントを開催しています。それ以外の時期には、Patent Examiner Technical Training Program (PETTP[1])の一環として、企業が特定のTCの審査官やTC内の特定のArt Unitに対して行う個別の技術プレゼンテーションを、特別に手配することができます。 コロナ禍において、出願人の皆様が代理人とともにUSPTOを訪れて、対面での審査官インタビューに同席し、技術の重要性を説明するといった機会が制限されている現在の状況において、自社の注目技術を審査官に直接アピールし、また自社の出願を審査する審査官達とコネクションを作り今後の権利化を有利に運ぶため、是非Tech Fair及びPETTPを活用して頂きたく、紹介致します。2021年に弊所では、数多くのTech Fair及びPETTPを手配し、審査官及びクライアント企業の双方から感謝の声を頂きました。 Tech Fair/PETTPの概要 一般的に、各企業が約1時間の持ち時間（プレゼンテーション：30-45分程度、及び、質疑応答：残り時間）で、審査官に向けて英語で技術内容を説明します。コロナ前は、USPTOに実機を持ち込んでのデモ実演等も可能でしたが、コロナ禍の現在は、ビデオ会議（USPTO側から招待されるMicrosoft Teams）にて行っています。毎回、５０人程から、多い場合は１００人近い審査官が集まります。 PETTPにおいて行う発表も基本的には同様ですが、Tech […]
