Xsensus News 拡大協働調査試行プログラムの活用について June 2, 2021 サマリー 拡大協働調査試行プログラム(Expanded Collaborative Search Pilot Program: CSP Program)は早期権利化に活用可能である 申請は無料で簡便な手続で行える 日米両国で申請した場合、IDS負担の軽減や、複数の関連出願の審査を一体的に進められる可能性が高いといったメリットも挙げられる 背景 米国特許庁では、審査促進のために、Prioritized Examination(通称Track One)、Accelerated Examination、Patent Prosecution Highway(PPH)といった様々な施策を実施している。しかし、Track Oneには高額な特許庁費用($4,200)がかかり、Accelerated Examinationの特許庁費用はTrack Oneより低額($140)であるものの、先行技術調査の上、Examination Support Document (ESD)の提出が課せられる為、調査コストやESD提出によるエストッペルのリスクがあり、PPHには特許庁費用がかからないものの、他国で特許可能とされたクレーム範囲と実質的に同じ範囲に限定されるといったデメリットがあった。そこで、コストのかからない実質的な審査促進策として、ファーストアクションインタビュー試行プログラム(First Action Interview […]
