As the federal government shutdown begins today, we want to assure you that the United States Patent and Trademark Office (USPTO) will continue normal operations without interruption.

The USPTO maintains an Operating Reserve built up over recent years, allowing the agency to fund ongoing operations even during appropriations lapses. This reserve consists of previously appropriated funds that can be legally spent under the Antideficiency Act.

What this means for you:

  • All USPTO electronic filing systems remain fully operational
  • Patent and trademark examination continues as scheduled
  • All statutory and regulatory deadlines remain in effect and must be met to avoid abandonment
  • No delays are anticipated for pending applications or proceedings

The USPTO successfully maintained operations during previous shutdowns, including the 35-day shutdown in 2018-2019 and the October 2013 shutdown, by using these same reserve funds.

We will continue monitoring the situation and will notify you immediately if circumstances change. In the meantime, please proceed with all planned USPTO filings and deadlines as usual.
